MY BUILDERR GAVE AFFIDAVITS TO ALL FLAT OWNERS WHO HAVE PURCHASED CAR PARKINGS IN 2002 and 2003. I have purchased one flat in the year 2006 i.e., second sale. the builder has not given any affidavit for car parking to the flat owner from whom I have purchased flat. But a car parking place was alloted to my flat and I am enjoying car parking in silt area. Now the builder who is in pent house over written my car parking allotment no with some other flat no. by creating an affidavit using old stamp papers purchased by one of the building partner with old date. Butin my east side carparking document west side border was written my flat no.car parking.
Wether unregistered affidavits are valid valid or not. A proof of boarder on east side document is sufficient to deal my case. please advice I am from Hyderabad. I will contact the advocate in the matter any advocate who will help me. my email address vsrao43@gmail.com ph.no.9441745369

Unattested stamp paper cannot be designated as an affidavit. You have a very good case in hand and it is better to obtain a stay order against the builder otherwise you shall be ultimate sufferer prattically.

I have recently purchased a flat in apartment along with car-parking. But I observed that there is no allotment of car-parking to my apartment in silt car parking place. The builder has already sold car parkings by making affidavit on 20 rupee stamp paper unregistered. The builder has purchased pent house along with 600 sq. feet closed car parking and utilising them for shops (business). The municipal authorities demolished shops and declared pent house as illegal construction. Now he is trying to sell shops place as car parkings. He has already sold one. He filed case against municipality requesting .permanent injection a against demolition of pent .house and shops was dismisses by court. Now the association is selling these parkings without allotting to me. Please advice steps to be taken by me in this regard. Can I file case in consumer court for my car parking. The pent house owner has having another parking total car parkings to him are 3. Is it justified.
