Limitation period

(Querist) 04 March 2013 This query is : Resolved 
A sends a legal notice to B informing him some position in respect of which B, if accepts the position has to keep quiet or to raise objection(s) if he has any. The legal notice, however,simply informs the position and does not mention any time limit within which B has to raise objections, if any. B duly receives the said notice sent by A but, inpite of having some objections to raise, cleverly keeps quiet for long time to raise such objections at an opportune time, if required.

What is the time limit in such a sitution within which B can raise objections, if any, and if B does not raise objections within such limit, A can assure himself that now B cannot raise any objection in future.

Experts may kindly advise legal position.

You have not mentioned the facts of the case without which you cannot get definite reply as the reply differs in situation to situation. In 138 NI Act, the limitation is just 15 days and in some civil suit this is 3 years and in many other situations this limit is 30 days or the specific period mentioned in the notice itself.

There is no time limit. Any of them can raise objection or take legal recourse at any point of time.

You have messed up the query which does not have any concern with Law of Limitation, rather it relates to conduct of one party,it's reactions to act and all would be dependent on several circumstances of a particular case for which there can not be straight way answer.
