my father was died in march 2006, one truck registered on his name was stolen in april 2006.the truck recovered from accused.., being legal haier i claimed the truck, court given it me on supurdnama with some condition and ld. court sent a copy of order to concern RTO. There was condition NOT TO ALAINATE..., Now since 2006 the truck is in the name of dead person i.e.my father.I applied concern JMFC for modification of order and seeking permission for to transfer it on my name..., accused given no objection.., prosection has no objectin but COURT is hesitating for permission as there is no xprees provision.., accused are abscond..., no possibilities of trial quick trial...., i m facing lots of technical difficulties...., help me.

Ask the magistrate to pass any order. If it refuses to modify the order then go to higher court, it would be allowed.

If your modification application is dismissed, file its revision before high court.
