Sale of tenented property

(Querist) 17 March 2013 This query is : Resolved 
Respected Sirs,
The landlord had given a property on Rent to a doctor A for hospital in 1972.
This property was given without any Rent agreement and NO pagdi was taken.
The Doctor A expired in 1986. His wife B who was NOT a doctor took over the property.
Since she was not a doctor it was not possible for her to manage the Hospital so she handed over the possession to her sister C and Brother in law D who were doctors.This was done under the pretex that the New persons entered would just manage the affairs of the Hospital. However the wife of the deceased doctor had actually sold the property to her sister and her husband WITHOUT entering into any agreement or paying stamp duty and without permission of Landlord.The rent receipts were still issued in the name of Hospital .
This New doctors C & D continued to pay rent in the name of the original tenant doctor who had expired.
After 10yrs this new doctors C & D formed a PVT LTD Co of Hospital without the N O C of the Landlord.
After formation of PVT LTD Co this doctors C & D transferred the Shares to 4th person who is a doctor E. This act was again without the permission of Landlord and No stamp duty or registration chgs paid.Here also the property has been sold for full transaction
A case was filed on all the erring parties by the Landlord but due to severe external pressure the Landlord had to withdraw the suit and consent terms were taken.
However the 4th party doctor E who is in possession of the premises has not obeyed the clauses of consent terms and Landlord has filed suit on him.
With violation of consent terms does the Landlord get the right to re-open the previous suit filed on B C & D The plaint of the New suit says that the Landlord to refer to and rely upon the previous suit proceedings.
All the erring parties have evaded payment of stamp duty and do not have any registered agreement with the Landlord.What action can be initiated.
The recent suit which is filed on Doctor E the Landlord has asked the court for maesne profit from the date of notice.Is he entitled for the same
