Cheque bounce

(Querist) 23 March 2013 This query is : Resolved 
my client had given me a cheque of Rs. 1,50,000/-. I had put the same in the bank. cheque was dishonourd. Bank issued a memo of "Insuffcient funds". I have sent legal notice to my client by speed post and registered post AD. But legal notice they have not received sent me back. Now can i file complaint aganist him in the court and how much time i have to wait for the payment. kindly help

You can straight way file the complaint after waiting for 15 days for the deemed receipt of the notice up to next 30 days. The notice in the given case shall be treated as received to you client.

If notice has been sent on correct address of drawer and he avoides to receive the same then notice will be deemed delivered to him.

what is the endorsement on postal AD card?

is it returned with remark refused .

then you can file complaint under section 138 NI

IF YOU POSTED NOTICE ON TRUE AND CORRECT LAST KNOWN ADDRESS, YOU CAN PROCEED TO FILE COMPLAIN AFTER 15 DAYS.

Even if the endorsement do not contain 'refused' and the notice has been sent on last known address, even then complaint is maintainable treating notice as have been sent and received to the addressee.
