Rights of the husband

(Querist) 25 April 2013 This query is : Resolved
Sir,
Iam living with my wife and children, after seven years of marriage me and my wife had some differences and she left me with our children to her parents house.
She joined me again after 4 years and within a span of five months we again had differences and again she left to her parents house and filed a dowry harassment case and share of property for minor children and maintenance.
After ten years there was a compromise between me and her that was allowed by the court. The court asked her to join me along with our two children but she did not come for two years.
Then I filed for RCR, then she joined me, but she wanted to live separately from my parents house and she bought an apartment and we moved into it.
Latter she bought in her sisters daughter to stay with us for her studies, even brushing aside my objections she bought her and got her admitted in one of the colleges.
After finishing her studies she joined a job and was continuing to live with us against my wishes.
As me and my children were parted for a long time, they never showed any proper respect to me, especially my second son who is very arrogant and always has a tiff with me.
My wife's father died before she came down here, so, she always go to her mothers house and spends her time there. Whenever there is a tiff between us, as I don't want to worsen the situation I go to my parents house to cool down the atmosphere.
She comes from a rich family and we are from a moderate family.
I get an income from other sources which I can provide basic necessities to maintain my family, but as she has come from a rich family she asks for more money for house expenses which I cant provide.
Sometimes I feel like going out of the house forever, but I have been sticking on for family values.
Now the children after finishing their studies are working but are not taking responsibility to share the expenses for house, the are just using their earnings for luxury items to the liking of their mother.
She has recently bought some agricultural land from the sale proceeds of one of the house which is on her name, and she is financially stable than me.
What would be my position if I walk out of the house, should I still maintain my children who are majors and have their own source of income which is actually more than me. And she having enough money from the rents she is getting from her property.
What can I do about her sisters daughter who is hanging in this place and we both have a lot off differences, she says as this property is not mine, I have no authority to ask her to leave the house.
Please suggest.

Since the apartment is owned by your wife, she would continue to be its owner if you decide to walk away from this major.
You are not liable to maintain your major son . However your daughter, if any , is entitled to maintenance even after attaining majority even as long as she is not getting married.
Since the house is not owned by you, you can ask for eviction of your sister in law.

You can refuse to maintain the relatives of your wife and can provide maintenance to her if you desire before the court under her due receipt.
