On paternity leave

I am working as a Govt. Servant and my wife just delivered a baby girl on 4th of May'2013. I want to avail my Paternity Leave but I want to know I have to wait for the sanction of this leave or such an intimation is quite necessary to avail the paternity leave.

Maternity Leave is covered by Maternity Benefit Act and there are provisions of r penalty and punishment both, if employer declines to provide benefits under this Act.

Paternity Leave: Not to be refused normally.
Apply for sanction.
A central Govt. employee can avail this leave 15 days before or within 6 months from the date of delivery of child. If such leave is not availed within the period, it shall be treated as lapsed.
