Claim of fd amount

Respected all,
I have kept a sum of Rs.3 lacs as a fixed deposit in a co-operative credit society, due to some misappropriation the society is now suffering from financial crises since last 2 years and they are not paying any amount to the deposit holders. also the managing committee have raised a huge amount of loan from this financial institution and they too not repaying their loan. causing extreme financial difficulty to the depositors.
in mean while i got all the fd amount transfer to my saving account maintained with that society and from their to my father in law's saving account who is also having sound deposits with that society.
now we are planning to file a suit in consumer forum to claim the amount in FD and SB.
So my query is can my father in law alone file a suit in consumer forum to claim the balance in his SB account ( including amount transferred from my SB account)

it is complaint before consumer forum not a suit . if money is lying in your FIL account and society is refusing to pay complain to RBI . you can file complaint before consumer forum too for deficiency in service

If all the money is now in your father-in-law's account then, he alone has to file the complaint in the consumer forum.

Agreed with Adv. Arachna. Please confirm whether winding is initiated or not. Also confirm whether the deposit in this society is covered by Deposit Insurance Guarantee Corp or not. If not try to extract your money even in parts if possible.
