Dear Experts,
Is eviction of rented house from tenant, in which she does not staying for a long time and not paying rent, a criminal offence?? No rent agreement was made.Does the owner be arrested for the same?? Please reply soon.

A tenant can not be evicted forcefully.But how shall tenant prove tenancy? At any rate police shall treat it a civil dispute.

Thank Sir for the reply but the SHO is threatening for the arrest of the owner because of this eviction.The lady has offered money to them.She is asking for a big amount for the closing of matter.Should We take help of an advocate as we are facing unnecessary harrasment from police deptt.??

Th SHO is doing the illegal thing. Lodge complaint against him.

even if you dont have rent agreement you must have been issued rent receipt earlier . i do hope you made payment by cheque to landlord . as pointed out by experts you cant be evicted forcibly . landlord will have to move court to obatin orders for eviction

Dear Experts,
Current situation is getting worse.The Police has lodged FIR u/s 448 of IPC against my friend for the removal of his belongings. Even SHO is asking for a high amount. Now the police is saying that the lady is moving to police head quarter and pressure is coming on SHO for applying section 380 as well. It was told to us by the SHO himself. My friend is running here and there for escaping arrest. Really We are feeling helpless. How could she file FIR for a property which she do not own?? A good and sound suggestion is needed ASAP.PLEASE HELP....
