sir, as i hve already filed a petition for divorce and now the case is sent to mediation centre and iam now ready to stay with her but she denied at the caw delhi saket that i dont want to stay anymore with him and i want my items back but the issue is that last year when she went to her home for 4 months then she has taken her jewellery as well as our jewellery which is called streedhan. And the same thing has being mentioned already in the legal notice which is sent to her after four months passed. So at the time of settlement if she ask for jewellery then what could i do...kindly reply plzzzzz

She said she wanted her 'items' back, did she say she wants her jewellary back? then, why are you imagining things unnecessarily? She may be referring to other dowry or gift articles. If she asks for jewellary then, you can reply that she had taken it with her while leaving home and show the notice.

actually 1 more query i hve that when i sent her divorce notice so in reply of that her advocate sent me reply that iam earning 1.5 lac per month salary and he asked for interim maientenance i.e sec 24 hma and he has written that my wife is not working but in actually she is working and in reality iam not working from last one year bcoj of my wife cruelty on me but as of now my case has been sent refer to mediation. Now in mediation iam going to say that i want to stay wth my wife just ask to my wife wheather she wants to stay or not...so if she deny then what will happen

if she refuses to stay with you case will proceed . you are well qualified bound to pay wife maintenance . if wife is working furnish evidence of her income .

Dear ajay sir, i just forgot to tell u that iam not hightly qualified i had 2 years diploma in hr and that was in distance mode and i was in job for 4 months in call centre i was drawing 11000 and i have proof of joining, resignation and bank statement so how would i pay maintenance to her and above all i attached her offer and acceptance letter and company name also mentioned in my notice drafting. actually she has fake mentioned that iam earning 1.5 lac per month even her advocate didnt mention the company name. And she is earning 20000. per month.

Dont panic. submit proof of your income and also submit proof of her income. if her income more than yours and if your are really not employed, court will award no maintenance to her.
Just try to bring out true facts before the court with proper documents

if your wife is earning Rs 20,000 per month and you were last earning Rs 11,000 per month your wife wont get mainttenance

Dear, all iam anvesh ...i got married on 27 nov 2010 and the query is that my wife got separated from our parents on 15th march bcoj of her desire and she has given written statement to police when pcr call by my father on 12 march the reason is as she is in habit of cutting of her vains and always threatining entire family on false case of dowry, domestic violence. since the date of marriage till 14 march2013 their is no complain made by my wife against my parents. now she has lodged a complain on 17 april 2013 to delhi commission for women , on 2nd may to saket police stn mentioning that i hve been expelled from my in laws house and on 3 june 2013 again she made a complain to caw saket against me and my father stating that domestic violence, mental torture etc. knowing fully well the next hearing will be on 5th june at tiz hazari court.
query-
can she make a various complaints at different agencies as she has already given written statement to my father on 15 march 2013 and as well as to police on 12march 2013 that "i want to stay separately from in-laws". it is not understood to my father as to why the complains are being lodged against him as she had already separated herself with effect from 15 march.
pls advise the further course of action against his daughter in law.

Immediately take the help of a criminal advocate. you need immediate legal help and not just advise.
Yes she can file complaints as many as she wants and at as many forums as wants.
Whether they will be proved or not depends on the evidence she is able to produce before the court during trial. But some offences against married woman are non-bailable. So get help of local advocate

dear all, i hve one concern, actually i got a streedhan list from my wife side at caw saket and they asked me to reply of that. When i was scrutiny her streeedhan list i came to know that 17 lac of cash, clothes,tent,decoration etc she has explained it and 4 lac of jewellery her father has given to us.but in actually it is totally wrong explanation given by her and on monday i hve to submit also my admit list.it is almost prepared but now how would i find that she has given wrong streedhan list.and if she produce fake bills of jewellery then in that situation what i need to do...kindly help out. it is possible to make fake bill of jewellery and will the court verify all this fake bills.

you deny receipt of Rs 17 lkahs in cash . your wife will have to prove the same . simlarly if Rs 4 lakhs worth jwellery has not beenr eceived you deny the same . let her prove that said jwellery was given . if she produces fake bills you can seek to cross examine the jeweller

query 1 - dear all, iam anvesh yadav i hve one query that my wife has made a complain against my father and me and we had attended 3 sessions of caw saket delhi. 2july 2013 also i hve to go at caw for my balance list of items that my wife has kept. and 3july we have a mediation at tis hazari court at delhi as the court case is subjudice and filed from my side on the base of cruelty and i want to know that what will the mediation do and i hve 2 recordings of last year in which it is clear fact that my wife and her father are creating some problems for me so shall i present that 2 recordings in front of mediation, will they listen it?.will they give importance to that recordings ?
query 2 - As the court case is sub-judice in tis hazari court delhi and petition for divorce filed by me so in the mean while i want the copy of complain which she had given to caw saket, delhi and i asked the enquiry officer for copy of complain but he denied it to give me. i want the copy of that complain, shall i file RTI whether i hve right to ask for complain copy and to whom i filed RTI so that i can easily get the copy of complain.or he can deny to give me bcoj as the court case is sub-judice. iam giving you the address of caw saket kindly give me the address to whom i send the RTI and format of the RTI like how to Write RTI in my case. the address of caw saket is :office of inspector caw cell south distt. old building ps malviya nagar behind pvr saket, new delhi.

query 1.- dear all i attended mediation date on 3 july 2013 at court and my wife advocate said at the mediation that we will remove all charges like 498a, dv act etc and u will be safe from caw cell saket, delhi, but in reply of that her advocate asked for 15 lakh rupees through mcd, but we denied for 15 lakh as we r not in the position and my father in law had spent only 6 lac in her daughter marriage and apart from this our jewellery is with her from last year worth rs 5 lac.
query2- my father is pensioner and im completely jobless and my wife is earning 20 thousand of salary,now the next date is on 17 july at mediation at court and we have planned that we will say that we r in position to pay only 3.5 lac if u want to say else we r ready to face any consequences bcoj divorce case is filed from my side and she has no proof regarding mental and physical torture but her advocate filed a false 498a case. so kindly advice me what to do ..

It shall be goo =d if you do not bow to the illegal demand raised by your wife and refuse to pay anything keeping in view your jobless situation. Let your wife decide what to do If you show your intention to pay something, their greed may increase and you may be forced to accept some more amount. Clearly refuse to pay anything.

Query- ON 10 APRIL WHEN MY WIFE THROWN ME OUT FROM OUR RENTAL HOUSE WHERE WE WERE RESIDING AND SHE KEPT MY PULSAR BIKE WHICH IS GIVEN TO ME IN MY MARRIAGE AND IT WAS REGISTERED WITH MY NAME. THE RC,INSURANCE PAPER ALL ARE IN MY NAME. HOWEVER THE RC IS WITH ME AND REST OF ALL PAPERS IS UNDER BIKE SEAT COVER. AND NOW THE BIKE IS AT HER PARENTS HOME.
ON THE NEXT DAY I HAD GIVEN COMPLAINT AGAINST MY WIFE TO MY AREA POLICE STATION IN DELHI INCLUDING BIKE DETAILS.
QUERY 2 -NOW WHAT WILL I DO IN EXTRA SO THAT IF BIKE BYDEFAULT LOST OR MIGHT BE STOLEN BY SOMEONE THRU MASTER KEY OR ANY INCIDENT TAKE PLACE BCOJ THE BIKE IS AT MY NAME AND IN FUTURE POLICE WILL TAKE ACTION AGAINST ME IF SOMETHING HAPPENS, SO FOR FUTURE I WANT TO SAFE MY SELF. NOW BIKE IS HER PARENT HOME.FROM 10TH APRIL 2013.

Issue notice to her that bike in your possession and return it to me. And that she will be liable for misuse or accident.
OR GET SEARCH WARRANT U/S 97 CR P C AND POLICE/ COURT WILL HAND OVER YOUR BIKE TO YOU. .

Dear all, as the divorce case is sub-judice in the tizhazari court filed by me for the divorce to my wife
QUERY- WHEN SHE WENT HER HOME FOR 4 MONTHS IN MAY 2012, LAST YEAR ALONG WITH ALL CASH , MY JEWELLERY, HER JEWELLERY,HER CLOTHES AND ONE DAY ONE TELEPHONIC CONVERSATION HAD BEEN RECORDED BETWEEN MY FATHER AND THE MEDIATOR THRU WHOM THIS MARRIAGE HAS BEEN FIXED AND IN THAT RECORDING HE WAS ALSO OPPOSED WITH MY WIFE ACT WHICH SHE DID IT AND HE WAS SAYING SOME TRUE THING AGAINST MY FATHER IN LAW AND MY WIFE.
I WANT TO ASK TO ALL OF YOU THAT WHETHER THE MEDIATION OR AT THE TIME OF ARGUMENT IN COURT WILL THE JUDGE GIVE IMPORTANCE TO THAT RECORDING OR NOT OR IT WILL BE CONSIDER AS A WEAK EVIDENCE....KINDLY ADVICE ME ON THAT AS SOON AS POSSIBLE..PLSE
