Last year one PSU advertised to appoint in executive posts. Requirement was 65% marks in GATE examination but final year students who will apprear 8th semister can also appliy. My relative who are appearing 8th semister applied for the post. He has declared his gradation of marks of earlier all semisters as needed in the application form. During his examination like other candidates he gave undertaking that he would bring the conversion method of marks of grades from university if selected. Later he selected in the interview and PSU management told him to send all his certificates including final years marks by a stipulated date. But before sending all his documents by the stipulated date PSU offered him appointment letter. When my relative went to join as per appointment letter that PSU told him that he has not secured 65% marks in total so he could be appointed. The fact is that if my relative even could get 100 marks in his last semister he could not get 65% in total as his earlier semisters marks were low.
My question is that my relative showed all the earlier semisters grades at the time of interview except the final appearing semister then how the PSU could refused his appointment on the ground that his has not got 65% marks?

it appears that appointment letter has been issued inadertently . if your relative does not fulfill the marks criteria laid down he cannot be appointed for the job . the basic requirement of securing 65%makrs was known to your relative at time of application . he cannot raise any grievance now

The management is not at fault if the earlier mistake has been corrected. You relative has no legal remedy if he do not fulfil the qualification.

The appointment was to be made on prefixed criteria which your relative did not qualify.
Like you and me the management also has right to correct things inadvertently done.
Your relative has no remedy.

If it was already declared that 65% was required, then nothing can be done if the marks are less than that.
