Place of birth change in indian passport

Hi,

I am currently living abroad and looking to change the place of birth in Indian passport.
Per advise from the Indian consulate here, i need a court order from First class judicial magistrate in India.
My permanent address is in a place called "kotagiri" which is near to City "Coimbatore" in the state "Tamil Nadu".
Looking for lawyers from the following areas - "Coimbatore", "mettuapalayam", "ooty", "connoor", "Kotagiri" to help me. Please share your email or contact number, i will reach out to you separately.

You have not given any email address.
Otherwise also most of lawyers would not like to contact you directly unless you contact them.

Data of the lawyers club of India may be searched. Engage lawyer after full verification whether he has experience in handling such cases or not.

In fact a person would be born at one place only so question to change birth place is very strange to talk about.

It should be spoken like i want to correct my place of birth which is place......but in records has been wrongly recorded as......

FOR WHICH AN APPLICATION AND AFFIDAVIT WOULD BE REQUIRED TO BE MOVED.IF ANY DOCUMENT OF BIRTH OF THE PLACE WHICH IS REQUIRED CAN BE ATTACHED AS EVIDENCE.

Dear Prabhakar Singh,

Yes you are right. I am not changing my place of birth in my passport. I am trying to have it corrected to match it with my birth certificate.

Are you aware of the process to obtain court order? This is what the Indian consulate wants me to do and I dont have any clue as how to do it.

You need to move an application supported by an affidavit before Magistrate of the jurisdiction stating the fact that 1.That you are(your name)s/o(name of father)Permanent R/o(the address should be within jurisdiction of the magistrate)2.That you were born at(write the correct birthplace)in proof whereof the birth certificate is attached here with.3. That due inadvertence or clerical error in your passport your place of birth has been wrongly recorded as to be(write wrong place written in passport)instead of (write the correct place of birth)for correction whereof an order is required from your goodself by Indian consulate at......
then phrase the prayer accordingly.

In UP previously it used to be filed before Chief Judicial magistrate of jurisdiction but now it goes before SDM of jurisdiction.
How it would goes in your state is not known to me.

Certainly you need a lawyer acquainted with state rules and procedure.Consulting concerned office may also be helpful when you are not getting a lawyer.

Dear Prabhakar Singh,
I thank you from the bottom of my heart for clarifying my questions. Request you to clarify my following questions too.

1) After an affidavit is obtained, by what means the application has to be filed in the court? i.e., should it be through a civil law suit or just a petition?

2) Since I am not in India now, should I mention in the affidavit anything about granting full access to my parents to make the request on my behalf?

3) Based on your response,I am planning to get an affidavit here in Canada and get it notarized by an attorney and send it over to my parents to take it forward with the help of a lawyer.
