Divorce

(Querist) 18 July 2013 This query is : Resolved 
My mother in law has sent divorce notice to my father in law.

In that she is demanding Rs.7500/ per month as compensation (Father in law having pension of Rs.17000/month)and portion of the property owned by father.

Some one please let me know what is the rule regarding this?


What is the legal calculation for monthly compensation??
Does it also have onetime settlement or both??

it is 1/3 of pension amount monthly.

It can be one time settlement or monthly. Choice lies with the parties.

she only has right to stay in matrimonial home .

As of now, divorced woman has no right to property of the husband. Only right to stay. But under new law, she has that right too.
