Society transfer fees w.r.t. sale transaction in blood relatives

I have purchased a flat in June-2010 from my brother. At that time society has not taken a transfer fees from us, since this was transaction between blood relatives. But now after almost 2.5 years, one of the member has picked this point saying transfer fees has not been paid by us to the society and in response to it society has sent me a notice. Please guide me whether I need to pay this fees as per society rules in those days. As I could not find any clear explanation w.r.t this any where in the bye law.
Society is saying that, if there would have been Gift Deed between me & my brother, I would not have to pay transfer fees, but we had a sale deed, hence need to pay the transfer fees. Please guide me.

no transfer charges are leviable for transfer between relatives . contact a local lawyer and reply to notice
