Ancestral property sale by father to his one of the son

Sir,


My father purchased ancestral agricultural property from my grandfather. My grandfather has 3 sons. without other 2 sons consent my grandfather sold the property to my father. Now my father has wanted to sell that property to third person without my consent.

I requested to pls. advise me on following issue.

1. Can father sell ancestral property to one of his son without other son consent?
2. Can i object the sale of property to third person?
3. Can i asked my father to sold property to me instead of third person to hold integrity of family?
4. Can i object original sale of my grandfather

Your query contains two different issues. One relates to the action of your grand-father and another is of your father.

So far as first situation is concerned, the act of your grandfather is illegal. As the property is ancestral in his hands, he requires consent of his other two sons to sale that land and so those two sons still have got their right to challenge the sale made to your father.

Now come to the case of your father. After purchase of the land from his father, the property becomes his own. He requires no consent from any quarter including you for the sale of that land/property.
