Property dispute

(Querist) 31 October 2013 This query is : Resolved 
MY father in law has two flats on his name. he expired just one month back. But this property is not bought out of his earnings itz bought by selling ancestral property.MY mother in law has filed a case on his two sons for the property. As per law she has a share in my FIL property. BUt since itz not out of his earnings whether that law is applicable

yes, she have rights, and all legal heirs have equal rights

If your father in law died intestate then his property will be devided equally among his heirs.

Any property acquired by using the money obtained from sale of ancestral property would be regarded as ancestral property.Hence ur mother-in-law is entitled for a share in the flat. She will succeed in her suit.
