Hi all, i want to file dowry, domestic violence and all harassment cases aginst my husband and inlaws since my husband has illegal relationship. I hv all supporting proofs to prove all his faults. Now im seperated and living with my parents for the past 3 months. In my hometown, police s not taking my complaint to file cade. They r directing me to go the police station in marital home. But i dnt want to file there since that ll not be comfortable for me to go for 7 hours journey. I have mentioned continuing offences in my complaint. But police s not taking. Pls suggest me.

You can file case from parental home also. If police is not taking complaint you can move to Magistrate for direction upon the Magistrate to register case.
Engage a local advocate for this and if you have any doubt regarding his advice you can come here for further advice.

In the case of DV case, you can directly file the case in the Magistrate Court under Domestic Violence Act (Precisely U/s. 12 of that Act). It can be filed from the place where you are presently residing. In the Case of S.498-A, the case can be registered only from the place where alleged offence occurred. If it had happened in matrimonial home, then the case can be filed from there only. If that police doesnot register the FIR, then you can approach the Magistrate directly by filing complaint under Section 156(3) read with S.200 Cr.P.C. for registration of the case under Section 498-A of IPC.
