Non receipt of rent from tenent

(Querist) 05 January 2014 This query is : Resolved 
I am one of the co-owner of an apartment under kolkata municipal corporation. I stay in a separate flat(not in the apartment). The other co-owner stays in the same apartment and collects rents from the 6 tenents. Every 3 months, he submits me the accounts of expenses and receivables from the property. I am not getting any rent from one of the tenents since past 14 months. The other co-owner said he is not paying rent. When initially I asked the tenent 1 year back, he said, he is paying rent. Now, when I ask him he says that I should speak to the other co-owner to whom he is tendering the rent and avoids me. Once he told me that I should not nag him, as a tenent legally can pay rent to any of the lanlords. What should I do to find out whether he is paying the rent or not? and what future steps should I take? Futher please let me know such disputes is governed by which law in west bengal?

You can file suit for eviction against such tenant on ground for default of rent if you think he not paying rent under WB Premises Tenancy Act.
If he indeed is paying rent your grievance lies against your co sharers. Issue notice against them asking for detailed receivables from the joint property.

It seems that the tenant is taking advantages of the two co owners. Have a clear discussion with the co owner and file suit of eviction for non payment of the rent.

Ask your co-owner to join in issuing legal notice on behalf of both you. The truth will come out. You have to decide against whom you have the grievance.
