Partition of fathers property

Dear Sirs,
my wife's father and mother both died leaving behind one property. my wife's elder sister ( only two sisters) has forcibly occupied the house and now denying the partition. what are the ways and means available to my wife. can she have the following solution.
1) to send a legal notice to evacuate the house that she is forcibly occupied now.
2) to send a legal notice to give share
please do advice.

send legal notice for partition of property . file partition suit .

sent legal notice for partition, but not claimed (postal authority mentioned the reason - "Door Locked, Intimation served" ) and redelivered to us. As suggested above, we have to file partition suit now. In which court we have to file the suit i.e whehter in DC court, or High court.
Normally what time it will take for the courts to decide the suit
