Advance pdc by builder under buyback

(Querist) 05 February 2014 This query is : Resolved 
I deposited certain money with builder. In agreement he allotted certaib area in his upcoming project. Builder also issued post dated cheque of after 1 year date(original amount + interest) that if buyer wants builder shall buy back the same. On presentation, the cheque bounced, what criminal / civil /consumer law remedies available to the buyer.

Yes have all the avenues, namely Civil court for recovery of money, criminal court for cheque bounce case, consumer court for deficiency of service; you may file a case each in all the three courts.

Two actions - Civil and Consumer courts depend upon the agreement.
Third action - cheque bounce - you can initiate criminal proceedings under Sec.138 of NI Act.
