My father died two years back without writing will.we are two sisters and one brother.my mother is there.my brother is not talking with us( two sisters and mother).
We have one house on my fathers name.now my mother want to give that house to three of us.what is the legal proses ? My brother is not talking to anybody
Of our relatives also.my mother want to Seattle the matter.please give the suggestion.

Your mother is entitled for 1/4th share which she can transfer to either or all others as she desire by way of gift, sale or relinquish.

As it was your father's self acquired property who died intestate and his estate devolved upon his widow, a son and two daughters equally as per Hindu Succession Act.Your mother has 1/4 so also is the case of each of you.Unless your brother joins the settlement proposed,suit of partition is the remedy.
