In laws threatening

(Querist) 08 March 2014 This query is : Resolved
Dear Experts

i would like to know the probability / chances of getting arrested if wife files all sort of false cases and husband has already filed rcr petition.

purpose for asking is that my in laws are continuously pressurizing my relatives and parents to make a settlement or else get ready to go behind bars as they are claiming that they have higher connections.

I am confident that nothing will happen but my relatives / parents are losing confidence and requesting me to make an settlement paying alimony which is out my budget as i do not earn that much second thing why should i pay if i am ready to maintain her.

Please advise what would be the best action.

if wife files DV case against you and your parents you wont be arrested . at most summons are issued and you have to fight case on merits .

only if wife files an FIR under 498A you can be arrested . in such acase obtain AB once FIR is lodged

fight all cases if any filed by wife on merits

It is better to settle unless the money is beyond your control.
Do not cower under threat. Nothing will happen and the case will loose all stem once you get bail.

If you defend the cases on merits, definitely it would be much much cheaper than paying lump sum alimony.
