Urgent help required

My employee left organisation without proper resignation of two months notice period.
He has not submitted phone to company which has imp files and information and joined our compititor.

Pl tel us can v go IT act sec 72 for remedy?
with that can v criminal complaint against him or FIR and under which sections?

please guset begging for help..Regards

tahx everyone..nadeem sir in terms and conditions there is clause of 2 months notice or salary,,,more imp is he has not submitted phone to company having all the info..pls tel what to do? i want him to tie in criminal action also..i should go for complaint or FIR? can he be arrested if offences are cognizable?pls also help about IT act sec 72 also...

Have you sent him any official notice or advocate's notice for fulfillment of requirement of the notice period and to return the property (phone) of your company.
