Dear seniors

Good evening.
divorce by mutual understading as been file in family court for divorce ,
but the husband is not attending court and the case is still pending.
now we want file fresh case for divorce by withdrawing the earlier case.
1.can this be done
2.on what base case can be withdrwan.

1) if husband is not attending court divorce petition would be dismissed .

2) wife can file for divorce afresh on grounds mentioned in HMA
