When you do not discuss the real problem and put a theoretical type of question llike a teacher to students of a class, how do you say that the question is not of academic nature.

Even now there is a lot of difference in your original question about drinking wine, taking cigarette and ganja, as compared to the latest position explained by you about a case of selling ganja. Still further, even the present position is not explained properly, as you have used two different terms, i.e., "selling ganja" (to consumers) and "taking ganja" (self consumption)," which are quite different acts in terms of law.

The question arises, whether you are concerned with the solution for the problem or you intend to seek maximum punishment for some person by knowing about the punishment for selling or taking wine, cigarette and ganja.

Frankly speaking, from your description, I don't think you are discussing about some real problem.

However, if your friend is really in that type of a problem, better he should immediately contact some local lawyer to fight the case on merits, rather than taking your help to get ready for punishment.

details of case.my few friends left job.they were doing job as security guard.they use to drink wine take ganja one of them has given passport to
employer.bcoz employee left the job employer registered a false fir for selling ganja charas and heroin and also employer not giving payment to employees, he also not giving voter id card what should they do now. shall that employee file fir against employer for not giving passport, not giving payment and for wrong filing of fir for selling ganja.

Since sales in narcotics is quite serious offence in law than taking drugs, your friend cannot defend himself with the help of replies to casual nature of your quries, as a layman, he must hire services of a good criminal lawyer to defend him.

you are still not clear why they left job and why employer should be agitated because "precious employee" a drunkard and drug addict has left the job of security guard. Instead employer would be happy to have got rid of him.

employer is unhappy because he has less no of employees ie security guard bcoz in this month of may all bhayas are going to uttar pradesh and in this business of security services many no of security guard are drunkar only.
