Guide me please what to do.

Recently I booked a 2 BHK flat in pune and paid a cheque of rs. 21000/- as a booking amount , and the said cheque was cleared from my account on 23/02/2014.

afterwards when I asked for the N. A. order from the Builder, he always delayed for the same.

When I received it, I found that the N.A. order is of 19/03/2014.

That means that the Builder was collecting the amounts even when he was not had even the NA order in his hand, and forget about the Town Planning Sanctions etc.

As also when I asked for the flat plan they refused to provide the same to me till 05/06/2014.

But one of my friend has also booked a flat with the same builder at the same site and building.

When I go through his agreement to sale of flat , I noticed that in his agreement , the flat plan attached does not show that it is a 2 BHK flat . Instead it shows that the flat is 1 hall, kitchen, and 1 study room instead of Two bedrooms.

Is it a serious matter?

I am confused why there is so much mismatch .

Kindly guide that what cautions I have to take before registering the agreement to sale.

As I have already paid Rs. 200000/- to the builder.
As also want to know that is it allowed to the builder to collect the booking amounts even when he has no N.A. order .

1) always buy flat from reputed builder .

2) dont purchase any flat unless builder has sanctions in place to carry out construction .

3) when you paid booking amount builder must have given you a receipt . it must have mentioned it was for 2 bedroom flat .

4) request the builder to furnish copies of building commencement certificate , IOD , and other documents of tile .

5)also inform builder that further payment would be on registration of sale deed for said flat

Can you guide that what all documents must be taken from the Builder.
I had asked for
1. 7/12 Extract of land
2. N. A. Order
3. Town planning sanction
4. Blue Print of Project,
5. Blue print of my Flat.

What is IOD and Building Commencement Certificate.
Unfortunately the builder is a reputed Builder. I have a copy of the Plan given to me of that building, which shows that it is a 2 BHK Flat.

The Intimation of Disapproval (IOD) is only an approval of the civil plans

permission granted by Muncipal corporation to start construction of building is known as commencement certificate . you can ask for inspection of documents mentioned by you

Even if the builder is reputed, you should take extra care in investing your hard earned money. Ask the builder to provide the necessary documents as advised by the expert ajay sethi ji.

One should be extra conscious while purchasing any property. It shall be good if you avail the professional services of a local lawyer for the purpose of obtaining a search report which shall consist not only the entire chain of the ownership but all other relevant information supported with the documents shall be provided to you.

Is there a rule that the builder can apply to Town Planning Department only after getting the N.A. order or can he apply even though he is not having the N.A. order.

N.A. is the last document hence he is required to apply previous to the issuance of that final document.
