Deemed rent

(Querist) 15 July 2014 This query is : Resolved

Should not deemed rent held void long time back? When there is no income, where the question arise of 'income tax'?
Devajyoti Barman (Expert) 15 July 2014
vague query.......
Pucki (Querist) 15 July 2014
It seems Shri Barman ji you have not understood the query. Deemed rent is levied when a person owns more than one house property. Neither of which is rented out. In such case, one which house is treated as self-occupied and other as rented out and rent as per deemed rent is calculated.

However such provision should be held void as when there is no income, there arises no question of income tax.

Dear Mr. Pucki,

The deemed rent should be void is your WISH. If you feel strongly about it, definitely you can take up the matter with High Court for getting the same declared as VOID.
