Accused not appearing for hearing

(Querist) 09 September 2014 This query is : Resolved 
in a criminal case accused is not appearing and has asked for exemption how can i pray
this not be considered specially since accused has been doing in no of case earlier and in diff courts ?
warrant was also issued person came and did not turn up again for hearing ?

You can bring it to the knowledge of the court. If the accused is not appearing even after warrant, you can demand proclamation on that accused.

It is discretion of the Court to grant/ deny personal appearance/exemption on application, which is used judiciously (generally in favour of applicant/accused)

You must ensure that the proceedings are not unnecessarily dragged on without any valid reason, just due to non appearance of the accused whether the proceedings are getting delayed?
