Sir,

Devajyoti Barman (Expert) 04 December 2014
The said person has no cause of action Though if the cheque gets dishonoured, he may file case against you but unless he proves existence of any loan, he can not succeed.
Get rid of such cheating friends.
Sailesh Kumar Shah (Expert) 04 December 2014
contact local lawyer and issue legal notice before bounce of cheque.
ajay sethi (Expert) 05 December 2014
if any cheque bouncing case is filed contest it on merits
malipeddi jaggarao (Expert) 05 December 2014
Send a legal notice to return the cheque as you do not owe anything to the holder.
Guest (Expert) 05 December 2014
You Could also File a Complaint with Bank as Cheque as Missing and Proceed accordingly with help of Local Good Advocate.
malipeddi jaggarao (Expert) 05 December 2014
Yes, you can give stop payment instructions to your Bankers giving the cheque number.
Sunil S Nair (Expert) 05 December 2014
Yes I agree with above experts file a complaint with the bank that the cheque is missing and all transaction to the said cheque should be stopped
Rajendra K Goyal (Expert) 05 December 2014
The cheque is a negotiable instrument and if that person is holder of the cheque in due course / against some consideration paid to your friend, he has good title of the cheque and can sue if it is dishonored/ bounced on presenting.
Guest (Expert) 05 December 2014
Here in this case the Person is Directly or Indirectly Not Connected to the Money Lender. He had not even signed any Surety or Guarantee on behalf of his Friend who is the Actual Borrower. Now the Stand is Cheque is Missing and The Complaint of Missing to be Filed with the bank First. If any one Presents the cheque it is nothing but Misuse of Stolen Cheque.
T. Kalaiselvan, Advocate (Expert) 09 December 2014
Yes to safeguard yourself against a criminal cheque bounce case, immediately communicate to your bankers about the missing cheque and instruct stop payment on presentation by a third party and since you are already in the knowledge of the older of your cheque, you may issue a legal notice to him to return the cheque held by him illegally without any valid reason.
V R SHROFF (Expert) 09 December 2014
Lodge missing complaints of your cheques to police. Get NC.
Issue notice, not to deposit cheques & return to you, if held by ..xyz
iNSTRUCT STOP PAYMENT TO BANK , FOR REASONS"MISPLACED" OR LOST
Guest (Expert) 09 December 2014
There is No Need for you to Issue Notice Not to Deposit Un Less you recieve any Communication from them regarding Cheque and their Conversation also to be recorded as Proof.
V R SHROFF (Expert) 09 December 2014
Communication from them may be 138 NI Notice. It will be too late and loose a defence opportunity. So notice.
Guest (Expert) 09 December 2014
When a Person is aware the Cheque is Lying with whom Whether he could file a Missing Complaint Only a Stop Payment in Bank would be allowed.

This fellow joined this LCI on 30 October 2013.

This fellow enrolled with the Bar Council of Tamilnadu & Pondicherry under Enrolment No. 1506/2012.

But within one year, his profile boasts as under:

"My name is N.J.S.Rajkumar, practising Lawyer. My Advocate circle calls me Narasimha.
I am Very much specialised in SEBI cases and handled several issues successfully.. Also specialised in Criminal Law, Civil Law and Business Law and I also hold a Diploma in Cyber Law .
I had taken up several cases dropped by others and made it a good success.SPECIALISED IN HANDLING ANY DANGEROUS AND CHALLENGING SITUATIONS ANY WHERE INDIVIDUALLY.
MY address 54.PARASURAMA EASWARAN KOIL WEST MADA STREET, AYANAVARAM , CHENNAI 600023.Mobile 09444036927 and 09967476751
Email Id rajkumar_wins@rediffmail.com
I stay in Mumbai every 15 days of the month for the case purposes and very frequently to Hyderabad."

Every lawyer worth his salt, even if he is connected to a big lawyer family, will know what a person who just enrolled can do / achieve within a year. Whereas this fellows false profile claims the above without any basis. Can there be any false claim than this?

The querist should be wary of taking advice from such a person.

Anonymous and M.Retarded I Prefer to Ignore. If Any Clarifications Required by any Genuine Experts Could Contact me.
Anirudh (Expert) 09 December 2014
You cannot ignore.
HAVING FILLED UP A FALSE PROFILE, YOU OWE AN EXPLANATION. YOU CANNOT SIMPLY ESCAPE. IT IS NOT THAT EASY, ESPECIALLY WHEN YOU WERE GOING ON PRESSING THAT OTHERS SHOULD GIVE THEIR PROFILE - EVEN WHEN LCI WAS NOT INSISTING FOR SUCH A PROFILE.
NOW COME ON.

TAKE THIS FELLOWS FALSITY IN HIS PROFILE. THIS FELLOW ATTACHES MORE IMPORTANCE TO THE PROFILE, WHILE HE IS FILLING UP TOTAL FALSE HOOD IN HIS PROFILE.

where he claims that he is practising from 2001, while as already indicated by me, he was enrolled only in the year 2012!!! CAN ANYBODY PRACTICE BEFORE ENROLMENT? IF ONE DOES SUCH A PRACTICE IS HE NOT FIT TO BE CALLED A "FRAUD"?
