Power of d.c

Guest (Querist) 24 December 2014 This query is : Resolved

Does DEPUTY COMMISSIONER holds a power to evict a permanent govt employee from govt house without any legal orders or any higher authority, by himself only ,when there are no legal grounds for eviction and the house is been alloted to that govt employee from last 35 years with monthly rent deduction....if so then on what grounds and what are the options for employees.

EMPLOYEE MAY FILE A WRIT PETITION.
Guest (Expert) 24 December 2014
Ms. Priyanka,

You would have been welcome with your personal problem, not academic query.

By the way, being a student (as per your profile), are you a permanent Government employee with 35 years of service? My advice to you, don't try to be oversmart to take everyone as idiot not to distinguish between a problem and an academic query.

If the query pertains to your own problem, better come forward with the background of real problem and the reason that led to the eviction of the employee. Otherwise, as advised by Shri Prabhakar Singh ji, file a writ petition. Let your own lawyer see what is legal and what is illegal.

PLEASE REPLY SHRI DHINGRAJI

""its my personal query""

"being a student (as per your profile), are you a permanent Government employee with 35 years of service? ""

HE HAS VERY VALID DOUBT OF GENUINENESS OF YOUR STATEMENTS..

1. I fully agree with the experts, donot adventure to be oversmart and play like a child with the professional experts on this platform.
2. Ask such silly question from the Deputy Commissioner himself who has issued such executive order.
3. Take a note that no officer,(IAS)appointed as DC, including the officer who has directed the errant employee to vacate the premises under the provisions of Eviction of Unauthorised Occupants Act is so bevkoof, rather you have pretented for yourself.
4. Stop this thread.

I did not visit her profile since i generally do not do so.

Though i doubted about genuineness of her query, but i thought it best to ask her to go around chambers of lawyers, if she really
have a problem.

just pretended to be one.....

The author has to be boycotted for her ill-mannered behavior. Instead of admitting the observations rightly observed by the experts, for the fear of being exposed, she is retorting in a hostile manner. With such an ill-tempered character she will not get proper advise or correct opinion even if she is hiring a paid service from any legal fraternity. I standby the experts to boycott this author.
