Death certificate late submission to the employer

(Querist) 20 February 2015 This query is : Resolved
Dear sir/madam
it's been 15 days My uncle passed away. i have applied for the death certificate on the second day itself. But my relative said that within 21 days of the death, the death certificate should be submitted to employer so that pension which he is getting will be stopped and again the nominee(i.e.., his wife) will get the pension on her name. But due to some technical difficulties in the govt sector they couldn't process the certificate and they are telling that it might take more few days.(above 21 days after death). Please tell me will there be any problems arises if i submit death certificate to the employer after 21 days of death. Please suggest me in this situation ASAP. thank you

Inform about death in writing under proper acknowledgment and mention that death certificate has been applied for and shall be submitted upon receipt from the concerned authority.

You have the option to attach the copy of death certificate issued by hospital/ cremation certificate/receipt issued by death registration authority.

Inform the department and the concerned Bank (in which pension is received) in writing that the person has expired and take acknowledgement. Submit the death certificate later on.

If the pension is received in the account ask the Banker to refund the same, do not try to withdraw it.

Mr Doab and Mr Goyal have advised well.
You could ask the Pension Paying authority the excess amount paid and you could refund it with interest as may be decided by the pension paying authority. Alternatively the amount paid by them could very well be adjusted against the dues payable to the the nominee (wife in this case)

Well advised by experts, the problem is not with the death certificate but to officially inform the employer about the death of the employee under him either with the a copy of the death certificate or without it but do it promptly so that the pension disbursement and disposal of other terminal benefits may be streamlined accordingly.
