Sir
One of the employee in our company will be resigning after completing 4 years and six months of service. Is he eligible to claim gratuity as per the Gratuity Act.

Premature query. Moreover, as an Accounts Manager, you need not bother your head for the present. Let the employee resign, the HR department of your organisation will look after the issue to sanction or not as per the provisions of the act.

The HR/Legal cell of establishment can respond to the claim.
The Act does provide for the better terms for payment even if employee is not eligible.
