Guest (Querist) 21 June 2015 This query is : Resolved
I sold my second hand car in February 2015 and got a note signed by him that he has purchased the car and taken delivery of the vehicle wef 25th February and also received all documents and requisite forms signed by seller for purpose of transfer by RTO.
But till date he has not got the car registered in his name and makes one or other excuse.
He lives in different city as I have relocated

What is implications and what best I can do

Since transfer document delivered duly signed by u it is his liability. If wish inform RTO Office
Rajendra K Goyal (Expert) 22 June 2015
Inform the concerned RTO with copy of the documents.
Dr J C Vashista (Expert) 24 June 2015
You are required to intimate RTO where the vehicle is registered but not yet transferred.
Sudhir Kumar, Advocate (Expert) 20 September 2015
In case the car registered in your name is caught in any crime in far off state then you will spend a good amount of money (worth buying 2-3 cars and large part of remaining life in frequent traveling and proving that car was handed over by you.

So pz act fast as advised by experts above.

To Avoid Consequences that could be of any Nature better consult your Local Advocates and Intimate the Same to Police and the RTO and Take Acknowledgements for the Intimations. If Possible Identify the Buyer and Implement the Changes.Recently One Person had sold the Car with out Transfer and it was Used for a Crime/Murder and the Seller had real pain and struggle to Come Out.If you are Financially Sound after the Complaints to RTO and Police an News Paper Publication Regarding the Same would be Preferred.

Thanks Rajkumar sir

I had posted my complaint with local Police chief both online and by hardcopy and has been duly taken on record. I have also sent intimation to RTO and they too received it. So many thanks to experts here for help.

Further if you have the Insurance Details of your Policy you could Intimate them Not to Renew the same in your Name Since it had been already Sold.Normally the Buyer would approach the Same Insurance to avail the No Claim Bonus.
Sudhir Kumar, Advocate (Expert) 20 September 2015
if the insurance is not renewed and the card plies on road under your registeration then you are personal liable for damages due to any accident it may cause and you are guilty under MV Act.

sir I have intimated Insurance company also and they have mothballed my bonus claim to adjust when I buy new car. Thanks for all the support

Narsimha sir, I dont think I can spare money for an advertisement. Rest all activities I have executed informing Police chief, RTO and insurance company in writing with all speed post letters delivered duly to authorities. Insurance company has frozen my bonus amount and i can avail that after new car purchase. Thanks for support
