Acceptance of duplicate c form in maharashtra

Dear Sir/ Madam,
Greetings of the day.
1)The original C forms have been lost & the duplicate C forms are available.
2)The Case is in Appeal.
3)The learned officer has declined to accept the duplicate C form citing Supreme Court case of Tamil Nadu though I understand that within Maharashtra,it is not applicable.
4)Request your valuable opinions with case laws to support my submissions.

A duplicate form obtained as per Rule 12(3) of CST Rules has to be accepted but a duplicate part of original form may not be accepted.

Dear Sirs,
Thanks for the prompt response.
Out of three portions i.e original, duplicate & triplicate, the duplicate portion(in original) is to be submitted.

Sir,
In respect to above, we have the second portion (duplicate ) as originals are lost/ misplaced. This part of C form is also issued by the buyer and the buyer has closed down his business resulting in non availability of duplicate part in red ink from department. Request your expert views as to how proceed as department is reluctant to accept & forcing for the payment
