(Querist) 19 December 2009 This query is : Resolved 
An illiterate man goes to buy medicines in a Medicine shop. The shopkeeper gives him the medicine which is expired due to which the man fall sicks . Can the man sue anyone ,if yes then whom?

he can sue the shopowner.

he can file a consumer complaint against the shop keeper but requires receipt for purchase of the medicines from that particular shop.

The man should have documentary evidence with him about the medicines supplied by the shopkeeper,then only he can file consumer case against the shopkeeper. In case the man have not any documentary evidence then he should complaint with the concerned police and also concerned drugs inspector to take appropriate action against the shopkeeper

its quite common that we people dont take reciept, even the shopkeepers are least interested in giving it.

if that person is not having any reciept then make a loud complaint against the Druggist/ Chemist in order to bring him to justice.

IF MAN HAVE RECEIPT OF PURCHASE OF MEDICINE FROM SHOP AND PRISCRIPTION OF MEDICINE GIVEN BY DOCTOR THEN MAN CAN FILE CONSUMER COMPLAINT.
