(Querist) 16 August 2015 This query is : Resolved
Sir
My Grandfather died without writing any will,he was retiered govt.employee nd in his pension account he named me as a nominee my grandmother is alive nd she is not giving anything to us only one uncle nor anything on house made by my Grandfather.what rights I could ask for.
Sudhir Kumar, Advocate (Expert) 17 August 2015
if your grandmother is alive she will draw pension and where do you as nominee comes in picture.

when she dies then the pension will stop you as nominee comes in picture only to receive unclaimed deposit of pension account.

Are U the grandson or granddaughter of the oldman? When UR grandmother is alive how were U nominated? Why are U after the pension of that old lady ?
Kumar Doab (Expert) 17 August 2015
The pension part has already been explained.

The Grandfather's estate shall be equally divided between his ClassI legal heirs i.e. wife, children.

If your father is not alive then your father's share shall be equally divided between your mother and you and your siblings.
SAINATH DEVALLA (Expert) 17 August 2015
Here the grandchild is bothered about nomination in the pension account.He/she has no right over the pension or the retirement benefits after the demise of the employee except the living wife.
Rajendra K Goyal (Expert) 17 August 2015
The widow has full rights to receive pension and other benefits of the deceased, grand son has no right in the property of Grand father till his father is alive.
