In arbitration if respondent party will not able to pay the fees to the tribunal & U/s 38 tribunal ask to claimant party to bear the fees of both the party & claimant is confirmed to pay the same in this situation will respondent party have right to put their claims and other rights in front of tribunal and if tribunal does not allowed them and insists to pay the fees in this situation what to do.three is any provision in law.please advice. WE ARE A CO OP SOCIETY (RESPONDENT) DEVELOPER IS THE CLAIMANT .
THE CLAIMANTS HAVE THEIR OWN ARBITRATOR & AND HC HAVE APPOINTED THE RESPONDENTS ARBITRATOR, AND BOTH THE LD ARBITRATORS HAVE APPOINTED PRESIDING OFFICER.
AS A CO OP SOC WE DO NOT WANT ARBITRATION AS WE HAVE NO FUND TO PAY THE ARBITRATORS FEES.AFTER TWO/THREE MEETINGS OF ARBITRATION THE TRIBUNAL ASK THE CLAIMANTS WHETHER THEY ARE READY TO PAY THE RESPONDENTS FEES OR THEY WILL SUSPEND THE ARBITRATION.
ON BEHALF OF CLAIMANT, THEIR ADVOCATE AGREES TO THE TRIBUNAL TO BEAR THE FEES OF THE RESPONDENT & REQUEST TO CONTINUE THE ARBITRATION,STILL THE TRIBUNAL DEMANDS ARBITRATION FEES FROM THE RESPONDENTS AND THEY DON'T ALLOWED US TO RAISE OUR CLAIMS ALSO.
IN THIS WORST SITUATION WHAT TO DO PLEASE SUGGEST US.

If the tribunal is insisting to respondent to pay the arbitrator, it becomes the duty of respondent to pay or cannot claim relief, the arbitration proceedings will come to a halt.

if tribunal is not providing the minutes of the hearing to the respondent party held by them and after even it is reminded to them by official letter in writing to furnish the same and still they are not favoring and fix themselves new fresh hearing date, under this circumstances what to do.
