Property divided

Hi,
My family is joint family till now.
my father is 2 brother and 4 sister.
and my grand father property in very less.
my father was in govt and he purchacase all property and make home as well they carry whole family of brother also including child nice nephew study to marriage...all money spend by my father... my uncle do nothing..whole life....my father now told that we equally divided all the land in all the son means in 3 parts 2 brothers me and my cusion, now my uncle demanding half property.... till now spend money by my father even they take food of my father money....
Please suggest me that if they case file in coart what will be the coart decesion half or my father choice....

@Author, in whose name, your father purchased the property? if he purchased the property in his favour, then no one right over that property. All the legal heirs of your grand- father have equal rights over the property. so try to make to convince your uncle in an amicable way.

First determine in whose name the title is.............and also that can your father establish that funds for the property were spent by him, if the property is not in the name of your father.



Show all docs on record to your able lawyer.

The question would be decided on the factor that in whose name property is?

If property was purchased by your father in the name of grandfather, your aunt (Bhua) and uncle has equal share in it, if it was purchased in the name of your father they have no share.

Try for amicable settlement, if property s in the name of your grandfather.

Whatever your father did for your uncle in maintaining him or his family and children would be of no consideration before the court, the property would be shared as per law (1/2 and 1/2)if those are in the name of your grandfather or in the joint name of your father and uncle.However, if properties purchased by your father are in his name alone only then your uncle can not legally demand any share.

Your English is intelligible and not all of us follow Queen English. Americans have their own English and so have many others but when it comes to Indians many of us plead Queen English even they themselves are not up to mark.Why not Indian have their own English, called Hinglish perhaps unknown to many.

Once we understand a problem we should answer instead of asking a querist to go for English coaching.

Hi sir, Thanks for reply sir after grandfather death they purchase all property by own name and my mothers name..but my uncle sad that I m illiterate they asking half property. Becaduse they convisied by some other people and my fusion also.

By conveying wrong fact you will certainly get wrong advise.

you are earlier saying your father purchased property you are now saying

"they purchase all property by own name and my mothers name"

please take help of English knowing person.

The title is in name of your father and mother and funds are own income of your father.

Your uncle has not made any contribution.

Your father and mother are owner of such property.
