time limit in filing complaint/case

(Querist) 03 January 2010 This query is : Resolved
after receiving reply to a legal notice from the respondent is there a time limit to file a case at

(a) consumer courts

(b) civil courts
Raj Kumar Makkad (Expert) 03 January 2010
The limitation before the consumer forum is 2 years and civil court 3 years from the date of accrual of cause of action which cannot be extended by serving a legal notice. So you have to decide keeping in view the facts of the case. However, if the respondent/defendant is State then you shall have to wait till the expire of the 60 days of the legal notice but the limitation is important.

Nothing is left after Raj Sir's advice.

thanks for the reply raj sir. However my doubt/question was apart from 2/3 years limitation period at consumer/civil courts, is there any separate time limits to file a case/complaint after receiving the REPLY to our legal notice like within so many days of receiving the reply?

or do you mean that,we can initiate further action(file a case etc) within the overall time period of 2/3 years from the date of cause of action?

Hope my question is clear?
