Dear Sir
My mother in law is airforce employe
And convicted jail 14 year.She has released from jain. Please advise she will get pension.

What were the finding of court?
Whether any departmental inquiry was conducted?
What type of charges were there?
Whether any other terminal benefits were paid to her?


Facts not enough to advice, discuss with local service law expert after showing him full case file.

You are silent whether she was civilian or unofirmed person of Air Force.

When a Govt servant is convicted by court of law then :-

(i) finding of couort is not relevant
(ii) nature of charges are not relevant
(iii) deppl inquiry is not to be conducted.

(iv) One SCN is to be issued to the employee (generally in Jail) and he/she can be dismissed after receiving reply thereof without any chargehseet and inquiry.

(v) deptt does not have to wait for his/her release from prison.

Please be specific if this procedure was followed by deptt.
