Esbtr property registration certifcate lost, unable to register property, please help.

(Querist) 07 May 2016 This query is : Resolved
I paid registration and stamp duty of 5 lakhs rupees through NEFT to Government account. I got UTR number and eChallan. but unfortunately after receiving eSBTR certificate, some how I lost it.
I approached bank to generate duplicate eSBTR certificate, but they denied my request.
I am bit confused, what to do, how to request for refund as I don't have original eSBTR certificate.
Online transaction details and eChallan is there but due to original certificate. I am not able to fulfill registration.

Please help me on this.

Have you approached the Registration Authorities?

Discuss with Registration authority / treasury official for procedure.

You can approach the bank by stating all the facts, to confirm and to issue acknowledgement by letter / duplicate receipt by the bank for the transaction. And the same can be produced before the Registration Authority by submitting a letter to them.

If Bank/Reg. Authority objects for the same you offer them INDEMNITY BOND with respect to the amount paid through NEFT and complete your registration or else you request for the payment back to you by cancelling registration if the amount paid is credited to the bank or treasury.

All the best.....

Thank you so much for your guideline,

Registrar is agreed to register the FLAT on a eSBTR Xerox Copy by taking additional fee, I am OK for that but now builder is asking a confirmation letter from loaned bank that, they first give a written letter with statement that disbursement amount cheque would be issued after registration, as he is more concern about his property safety. Now I am approaching Bank to issue such written letter to builder by offering them INDEMNITY BOND.

I am having Question, Will this registration cause any issue in future resale, please advise.
RAVI K GOUD (Expert) 11 May 2016
What sort of problem you are predicting in future resale?

Once the registration is done on your name with proper title and documentation, There would not be any problem.

As a precautionary measure you take all the required documents from the builder before handing over the disbursement letter to him. It better to consult & take the advice of the local lawyer with regards to the receipt of the documents from the builder. If you takes care of this then there would not be any problem for resale.

I went to Builder and builder was not ready to sign on agreement until he sees the original copy of esbtr certificate on agreement.... finally I paid 5 lacks again as stamp duty to proceed for registration and fighting in court with registration team who based in Pune location since last year to claim my first amount 5 lacks, which I paid and certificate got lost.

Lawyer is also working on it strongly and we are seeing progress...if anyone is facing this challenge paid twice stamp duty or lost esbtr not getting refund from Maharashtra registration office please contact me for any assistance or advice...9976037685.
