Sir the accused after being convicted in a complaint u/s 138 of NI Act being filed by me has filed appeal u/s 374(3)(a) Cr.P.C in session court and also filed criminal Misc. Petition (Main) u/s 482 Cr.P.C in Hon'ble High Court against the order of conviction.Is this move of the accused/appellant to file appeal in Ld session court and Hon'ble High Court simultaneously legally maintainable ?

Both the proceeding will not lie simultaneously.
So bring this fact in both the courts as a result of which one proceeding will surely drop.
