Ruels about NOC by Employer for another Job

Sir my friend is an officer in the Syndicate Bank and he has got a call for interview from IGNOU for the post of Asst registrar whish is a much higher post than current but he needs NOC from bank to attend the said interview. But the personnel dept of bank says that NOC can not be issued though there is no bond on the part of my friend kindly guide us in the matter or give the refrence of any such case.

Your friend is working in a Government of India undertaking. Under the norms, your friend ought to have forwarded application for employment through the present employer in which case the present employer becomes obligated to issue NOC. Now nothing much could be done legally. Only recourse is to request the authorities in Syndicate Bank personally for NOC.

My view point is that denial of NOC by bank authority is infirnging the fundamental right of bank employee to work somewhere else, without assigning any reason. Simply ask the bank authorities to issue NOC immediately and if they refuse or if they will be silent, move the H.C. under Art.226, writ jurisdiction.

Sir can I ask information about the matter from my own department under RTI act. If for this bank can take action against me.

Yes. You can move RTI application as a citizen of Indian to get information on this point or any other point. If you feel any hesitation that revengeful steps may be taken by higher authorities, you can ask one of your friends to file RTI seeeking the information what you want.
