(Querist) 26 January 2010 This query is : Resolved
Hi All,

I lost my cell phone somewhere and as I wanted the new SIM for my Prepaid Mobile so I approached Police Chowki and asked to file complaint for the same in their Daily diary. They asked me for Affidavit for the same.

So as per CRPC anyone can file compaint without any charge or any affidavit but the police persopnnel informed me to get the affidavit anoly then they will entertain my complaint.

I get that affidabvit arranged and they easily provided me the complaint copy.

Now my quest is that is it mendatory in all cases including cognigable , non-cognigable or lost cases the complaint need to have affidavit or not..

Affidavit is being insisted by the police authorities to authenticate your report of loss. Nowadays it has become a rule.

Police has done as per rules and no violation of any type has been made by them.
