This query is : Resolved
Suit for partition and possession of property was filed and pending in court for evidences. I hold share 1/6th as per jamabandi. The defendants have annexed electricity bills, water connection in their evidences. Presently they are holding the property as due to my service I could not stay in the property. My query is if I do not stay in the property but my share is there will I be entitled to any relief.

You should be having a share..(per facts and merits)
Bad faith adverse possession may not stay in courts..

If you are one of legal heir of that property, you share will not be distrubed. consult your local counsel with the documents/papers you have.

If the case is already pending in the court for evidences, you must have engaged a lawyer to defend your case. So, is there any specific reason that you have not asked this question from your own lawyer? If not yet engaged, please do the same.

They can't forfeit your share in the property merely on the basis of electricity bills, if paid by them. Electricity bills with consumption of electricity denotes their own usage and liability for payment if they live there. That cannot affect your share in property, if eligible as legal heir of the deceased, as per law.

Presumably the property is an agricultural land inherited by you, isn't it? If so, your share is intact and there is no problem in acquiring your share on the plea that you were not in possession due to your service.
Electricity bill do not confer title on any person, conversely jamabandi is a conclusive evidence for your share.
Consult your lawyer for better and proper guidance.

You have a right to claim your share amount but need to pay Court Fee of the value of your share as since you are not in its possession.

Electricity bills or entries as to Jumabandi are not decisive as to title to the property. Please post the relevant facts so that a meaningful suggestion could be attempted.

Facts are that while I was in service my own brothers have taken over the possession of house after the death of my parents and they do not allow me to use the same and do not allow me to entry. My name is included in Jamabandi showing my share besides I have ration card, driving licences and residence certificate on the same address.

If you are one of the legal heirs of deceased owner and entitled for a legitimate share in the property as per succession act, as per your personal law, your share in the property shall be allotted to you.
You cannot be deprived of your rights.

My father died long back and property was devolved upon my mother, brothers and sister. After the death of my mother her share devolved upon my brothers, sister and myself. My father and mother did not made any will. I was living in this property for long time but when I joined my job I used to visit regulary and since my bank passbook, driving license, ration card are on the same on the disputed property and case is pending for partition of property and possession. On the Jamabandi there is my entitled share. Only the opposite party have annexed electricity bill.
