Very vague description of your query. Instead of vague academic query, discuss the real problem in a proper way. Anybody can get confused, whether the employee resigned from his post before his death or his son resigned from his job before the employee died. Also, whether the employee was serving in any Government department or was working in some private organization.

1st thing 1st; download the rules pertaining to 'Compassionate Employment ' of establishment and submit application in time and under proper acknowledgment..
Also check if the establishment provides 'solatium'!

The son is eligible for compassionate appoinment,in case his father was a State/Central Government employee.

He is eligible not for employment but only for "consideration for employment". There is no guarantee he will get the employment.
He can apply only if he is not employed that does not mean that he should be sure of getting govt job by self inflicted unemployment. Other contestants within 5% ceiling can complain even after employment.

Very right observation of Mr. Sudhir Kumar, if your question related to Government employment. No surety for job, that all depends upon eligibility conditions of candidate, waiting list and the No. of vacancies reserved for employment on compassionate ground.

The deceased employee was with Govt establishment?
The rules of compassionate employment must be easily available.
Check with LOCAL office HR/Admin, employee's unions leaders or colleagues of deceased employee.
Also check if establishment pays solatium instead and has been paid..
If compassionate employment is offered by establishment then submit application if eligible per rules and complete the procedure.
Also understand conditions, NOC and affidavits etc
