Succession Certificate

(Querist) 16 March 2010 This query is : Resolved
What are the latest guidelines regarding obtention of Succession Certificate? The applicant holds Legal Heirship Certificate and there is no dispute in the family as there is implied and express consent from all the legal heirs
Raj Kumar Makkad (Expert) 16 March 2010
If all the legal heirs of the deceased are agree than it is very simple as all can become petitioners and can sue general public before the court seeking succession certificate and after due notice to the public through publication, ex-parte petition shall be proceeded and after due consideration by court, order shall be pronounced as sought in the petition and after this when succession certificate shall be issued required stamp duty (in Haryana it is 3%) calculated on the value of the property involved shall levied and it shall be released.
