partition in agri,land

(Querist) 04 April 2010 This query is : Resolved
our father has self acquired agri.land[6.2 Acres] in aurangabad-maharashtra, he expired in 1982 instate.mother expired prior to him[1965].we are [7] legal heirs-4 bros.3 sisters.our brothers enjoying the benefits of agri.produce.because of this we sisters want ppty. to be partitioned i.e.6.2/7=0.88 Acres each. is it possible legally ? if so how to proceed with ? what role the collector have in the matter ?

In absence of any partition deed prior to 1989, all daughters have equal shares in the property which includes 'mesne profits'. The sisters can verify the land records of the collector (ie., patta name) and if it bears the old owners' name, they can present an application to him seeking not to issue fresh patta in anybody's name till the dispute is not settled. Other than this, there is no role of collector in this matter. Information like crops cultivated at particular area and harvest results can also be sought from collector to arrive-upon the 'mesne profits'.

I agree with the above opinion.
