Hi,
I want to know that under section 13 of the P.F.A. Act whether registered post of Public Analyst report to accused shall not be presumed served untill prosecution proves that it is duly served to the accused. What is the latest situation or rulings regarding this matter. Pls help me.

PREVENTION OF FOOD ADULTERATION ACT CASES ARE CRIMINAL CASES AND ALL DOCUMENTS AND REPORTS OF EXPERTS ARE FILED IN THE COURT WITH THE CHARGESHEET.THE ACCUSED CAN GET THE COPIES OF THE SAME FROM THE COURT THROUGH HIS ADVOCATE.IN CASE HE WANTS COPY OF THE SAME HE CAN APPLY FOR CERTIFIED COPY FROM THE COURT BY SUBMITING APPLICATION FOR CERTIFIED COPY BY DEPOSITING REQUIRED AMOUNT IN COURT FOR COPYING CHARGES.
THE SAID REPORT COPY IS SENT TO THE COURT AND ACCUSED CAN DEMAND COPY ON COURT DATE OR AS PER THE PROCEDURE AS EXPLAINED ABOVE.

It is general presumption that if registered post has been made then it has duly been received by recipient until it is received back.
