Perjury Application

Dear Sirs, please advice on how to draft a Perjury application when the complainant is lying under oath in the court. Or at least advice the format and ingredients of such perjury application and what the final prayer should be.

You have to swear to an affidavit to be filed along with the application seeking action for perjury. You have to neatly and specifically describe the false replies given by the complainant one by one with the questions also. You have to specifically plead that the complainant has given such false replies knowing fully well that they are false. You have to annexe a certified copy of the deposition of the complainant also to the petition. You have to request the court to initiate appropriate penal action under law for the offence of perjury against the complainant and deal with him according to law.

I suggest u to file the application of Persury under section 340 Cr.P.C. after the evidence is concluded. Prior to, it will be too early to initiate the said proceeding.

Simply give detail to court in writing, and pray under sec 340 Cr.P.C to take action against the person who gave false affidavit or evidence.
